Marriott International, Inc. offers the Marriott Bonvoy^™ loyalty program (the "Loyalty Program") which operates under the Loyalty Program terms and conditions.

Nonprofit donations are managed by Maritz Motivation Solutions Inc. ("Rewards Provider") on behalf of the Loyalty Program. Donations are not tax deductible.

All donations are non-refundable and non-cancellable.

By redeeming for a non-profit donation, you must read and accept all these Terms & Conditions and the Privacy Policy. These Terms & Conditions and the Privacy Policy may be modified without prior notice, and such modification shall be effective upon posting on this Website. You agree to be bound to any changes to these Terms & Conditions and/or Privacy Policy when you make a nonprofit donation.

Prohibited Activity

You agree to act in a responsible and legal manner when making a nonprofit donation through the Loyalty Program website ("Website"). You shall comply with all applicable laws, regulations and rules and undertake not to use the Website for any unlawful purpose, for the commission of any offense or crime under the laws of any jurisdiction to which access is obtained through this Website or in a manner which is likely to cause harm, offense or nuisance to any other Internet user.

Rewards Provider reserves the right to investigate and take appropriate legal action against anyone who, in Rewards Provider's opinion, violates this provision, including, without limitation to, reporting you to appropriate law enforcement authorities.

Indemnification

By accepting these Terms and Conditions, you agree to indemnifiy and otherwise hold harmless the Rewards Provider, its officers, employees, agents, subsidiaries, affiliates and other partners from any direct, indirect, incidental, special, consequential or exemplary damages resulting from (i) your use of the Rewards Provider services; (ii) unauthorized access to or alteration of your communications with or through the Rewards Provider services or (iii) any other matter relating to the Rewards Provider services. Any business transactions which may arise between Loyalty Program members ("Members") from their use of the Rewards Provider services are the sole responsibility of the Members involved.

Privacy and Disclosure

Use of the Rewards Provider services is also governed by our Privacy Policy, which is incorporated into these Terms by this reference. Without limitation of the Terms and Conditions set forth in our Privacy Policy, you understand and agree that the Rewards Provider may disclose personally identifiable information if required to do so by law or in the good faith belief that such disclosure is necessary to comply with legal process, enforce these Terms or protect the rights, property or safety of Rewards Provider, its Users and the public.

Governing Law

These Terms will be governed by and construed in accordance with the laws of the State of Missouri without regard to conflicts of laws principles and you agree to submit to the exclusive jurisdiction of the courts in the State of Missouri. The English language version of these Terms shall take precedence over any translated versions thereof in the event of any inconsistencies.

Donations

You can make a non-profit donation using points only. All donations are non-refundable. The email you receive directly after your donation is processed is considered a confirmation for that donation.

You hereby acknowledge that the Loyalty Program and the Rewards Provider have no control over the use of donations that are made to charities through this Website.

We have the sole discretion to enlist/delist nonprofit organizations in our provision of this facility.

We reserve the right at any time to modify or discontinue, temporarily or permanently, the donation facility with or without notice. You agree that Marriott Bonvoy and the Rewards Provider shall not be liable to you or any third party for any modification, suspension or discontinuation of the facility.

Donations made to a non-profit organization will be given to that nonprofit organization only and no substitution of donations between nonprofit organizations shall be permitted.

Disclaimers

To the fullest extent permitted by applicable law, the Rewards Provider shall not be liable to any Member under contract, tort, equity or otherwise for any loss or damages arising out of the Rewards Provider's connection with the Member's use of the Website or the provision of services by the Rewards Provider, whether any of the foregoing are, without limitation, occasioned by the negligence, fault, error, omission, act, or breach by the Rewards Provider its employees, contractors or sub-contractors. Without prejudice to the generality of the foregoing, under no circumstances shall the Rewards Provider be liable to any Member for any consequential, economic or indirect loss or damages, loss of profits, revenue, business, capital, administrative time or loss of use of data or software, howsoever arising.

General Terms

These Terms are accepted upon your use of the Rewards Provider services and is further affirmed by you becoming a User.

These Terms (together with any New Terms) which incorporates the Privacy Policy constitutes the entire agreement between you and the Rewards Provider regarding the use of this Website and the Rewards Provider services.

These Terms operate to the fullest extent permissible by law. If any provision of these Terms is unlawful, void or unenforceable, that provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.
